Privacy Policy
  1. General
    1. This Privacy Policy describes how RedCloud and its affiliated companies (“we,” “us,” “us,” or “RedCloud”) as well as our unaffiliated service providers treat personal data that we collect through the Marketplace. Due to the B2B character of the Marketplace (see Terms and Conditions of Use of the Marketplace No. 2), the processing of personal data is the exception. We therefore expect to process only limited personal data. All the terms that are not defined herein shall have the meaning ascribed to them in the Terms and Conditions of Use of the Marketplace (the “Terms”), which Users the Marketplace (“Users”) accept with the use of the Marketplace. The Terms may be updated from time to time at the sole discretion of RedCloud.
    2. To use the Marketplace efficiently and securely, Users must sometimes provide certain personal information/data (“Personal Data”), such as their name and surname, e-mail account, telephone, billing information, and any other information required to provide the Marketplace Services. Therefore, it is required that the information provided is updated, true and accurate. The basis for us to process personal data is the execution by the Users of the Terms and Conditions of Use of the Marketplace, which shall constitute a Contract valid and binding. We may share Personal Data with affiliated companies.
  2. Provision of Personal Data
    1. Users may choose voluntarily , but are not obligated, to provide us with additional Personal Data for business reasons only, such as gender, preferred language(s), city, or other information, such as when Users fill out a form, respond to surveys, participate in promotions, communicate with our helpdesk team, or share their experience with us.
    2. Also, when Users use the Marketplace and Payment Services, we collect personal information automatically. This information may include: (i) Geolocation information, such as precise or approximate location, determined from mobile device’s IP address or GPS. We may also collect this information when Users are not using the app if it is enabled through device settings or permissions; (ii) Usage information, such as the pages or content, searches for Products or Services, social media and other actions taken on the Marketplace; (iii) Log Data and device information (including clicking on links to third party applications), IP address, dates and times of access, hardware and software information, unique identifiers, error data, cookie data, and the pages viewed or interacted with before or after using the Marketplace; (iv) Cookies and Similar Technologies, as described in this Privacy Policy; and (v) Payment information, such as the payment instrument used, date and time, payment amount, payment instrument expiration date and billing zip code, address and other details related to the payment, including information about interaction with content and services available through RedCloud.
    3. To the extent permitted by applicable law, we may receive additional information about Users, such as references, demographic data, or information to help detect fraud and security issues from third party service providers or partners and combine it with information we have about Users.
  3. Usage of Personal Data
    1. We use Personal Data to improve and develop the Marketplace in order to: (i) enable access the Marketplace and the sale and purchase of Products; (ii) perform analytics, debugging and research; (iii) communicate with by inter alia sending messages, updates, security alerts and account notifications,; (iv) detect and prevent fraud; (v) configure and personalize the experience based on interactions with the Marketplace, the search and purchase history, preferences and profile information, and other content submitted.
    2. We use Personal Data to: (i) create and maintain an environment of trust and security; (ii) detect and prevent fraud, unwanted messages, abuse, security incidents and other harmful activities; (iii) conduct security investigations and risk assessments; (iv) verify or authenticate information provided, perform checks against databases and other sources of information; (v) help resolve disputes; and (vi) comply with the law, respond to lawful requests, prevent harm, and protect our rights.
    3. We use Personal Data to: (i) provide, personalize, measure and improve our advertising and marketing; (ii) personalize, measure and improve our advertising; (iii) administer programs, rewards, surveys, or other promotional activities or events sponsored or operated by the Marketplace or its third party partners; and (iv) analyze characteristics and preferences to send promotional messages, marketing, advertising and other information that we believe may be of interest.
    4. We use Personal Data to: (i) allow or authorize third parties to use the Payment Services; (ii) detect and prevent money laundering, fraud, abuse and security incidents; (iii) conduct security investigations and risk assessments; (iv) comply with legal obligations (such as anti-money laundering provisions), and (v) provide and improve the Payment Services.
    5. Any use of personal data relates to the operation, functionality and improvement of the Marketplace and/or the Services and is necessary for or based on the legitimate interest of RedCloud or the preparation or fulfillment of an agreement with the Users.
  4. Compliance with law
    1. We may disclose information to courts, law enforcement, governmental or public authorities, tax authorities or authorized third parties to the extent we are required or permitted by law or when disclosure is reasonably necessary to: (i) comply with our legal obligations; (ii) comply with a valid legal request or respond to claims made against RedCloud; (iii) respond to a valid legal request in connection with a criminal investigation to address suspected illegal activity, or respond to any other activity that may expose us or any of our other Users to legal or regulatory liability. We will never disclose information without legitimate reason.
    2. Where applicable, we may notify Users of lawful requests unless: (i) notification is prohibited by the legal process itself, by a court order received, or by applicable law, or (ii) we believe that providing notification would be futile, ineffective, cause a risk of injury or bodily harm to a person or group, create, or increase a risk of fraud or harm to RedCloud or Users, or expose RedCloud to a claim of obstruction of justice.
  5. Service Providers
    1. We share Personal Data with affiliated and unaffiliated service providers to help us administer our business, including service providers that help us to: (i) verify identities or authenticate identification documents, (ii) match information against public databases, (iii) conduct background or police checks, fraud prevention and risk assessment, (iv) develop, maintain and debug products, (v) enable the provision of the Services, (vi) provide customer service, advertising or payment services, or (vii) process, manage or evaluate insurance claims or similar claims. These vendors are contractually obligated to protect Personal Data received and have access to it to perform these tasks.
    2. If applicable, where a data recipient is located outside the EEA, RedCloud will implement, if necessary, appropriate data protection safeguards in accordance with applicable law.
  6. Cookies
    1. The Marketplace may use a tracking system using “cookies”, so that access to information, when moving from page to page, is done more quickly. It also helps in some cases to identify Users, without the need to ask them for their password again and again. These cookies are small files sent by the visited page and are stored on the hard disk of the computer, occupying little space. Users are informed that by using their browser options they can limit or restrict the hosting of these “cookies” as they wish, although it is not advisable to restrict them completely. The system may collect information about preferences and interests. In the event that this occurs, the information will be used exclusively for statistical purposes to improve the services provided on the Marketplace.
  7. Right of access, rectification, or deletion
    1. In relation to their Personal Data the User may exercise their rights of access, rectification or deletion, and request exclusion in accordance with the provisions of the applicable regulations on the subject by sending an email to the help center email address: Nigeria – nga.support@red101.com, South Africa – customercare.za@redcloudtechnology.com
    2. In case the Personal Data is processed by third parties, a request for rectification, erasure or restriction will be forwarded also to such third parties unless this proves impossible or involves disproportionate effort.
    3. In certain jurisdictions, Users may request that Personal Data be deleted. Please note that if we receive a request to delete Personal Data: (i) we may retain Personal Data as necessary for our legitimate business interests, such as money laundering prevention, fraud detection and prevention, and security enhancement, and (ii) we may retain and use Personal Data to the extent necessary to comply with our legal obligations.
  8. Security
    1. The personal information that Users enter on the Marketplace is completely confidential and we will use commercially reasonable efforts to protect their privacy. When data and numbers corresponding to credit cards are entered, these are encrypted according to security standards, for greater security of the Users.
    2. It is important that Users protect themselves against unauthorized access to their Accounts, passwords and to their computers, devices, and applications. We recommend using a unique password for each Account that is not used on other online accounts. Be sure to log off when finishing using a shared computer. In the event of a breach, the User shall immediately inform RedCloud.
  9. Retention periods
    1. Personal Data will be retained only for as long as a User remains registered in the Marketplace and, if applicable, as long as required by statutory retention requirements. If an Account is closed, we will delete all Personal Data we hold about this Account. This excludes data for the fulfilment of our legal and contractual obligations.

  10. Modifications
    1. We reserve the right to modify this Privacy Policy at any time, in accordance with applicable law. In that case, we will post the revised Privacy Policy and will also notify Users of the changes using the Marketplace at least thirty (30) days prior to the effective date . If Users do not agree to the modified Privacy Policy, they may cancel their Account. If Users do not cancel their Account prior to the effective date of the modified Privacy Policy, continued use of or access to the Marketplace will be subject to it.

    1. Esta Política de Privacidad describe cómo RedCloud Argentina S.A. y sus empresas afiliadas (“nosotros”, “nos” o “RedCloud”) tratan los datos personales que recogemos a través del Mercado en Línea. Todos los términos que no estén definidos en el presente documento tendrán el significado que se les atribuye en los Términos y Condiciones de Uso del Mercado en Línea.
    2. Para utilizar el Mercado en Línea de forma eficiente y segura, los Usuarios deben proporcionar cierta información (“Datos Personales”), incluyendo su nombre y apellidos, cuenta de correo electrónico, teléfono, información de facturación, y cualquier otra información necesaria para facilitar la prestación de los Servicios, sin la cual sería imposible proporcionar los Servicios. Por lo tanto, se requiere que la información proporcionada esté actualizada, sea verdadera y exacta. La base para que tratemos sus Datos Personales es la ejecución por su parte de los Términos y Condiciones de Uso del Mercado en Línea, que constituirán un Contrato válido y vinculante.   2. Suministro de Datos Personales
    1.     2. Además, cuando usted utiliza el Mercado en Línea y los Servicios de Pago, recopilamos información personal automáticamente. También podemos recopilar esta información cuando no esté utilizando la aplicación si la habilita a través de la configuración o los permisos de su dispositivo; (ii) Información de uso, como las páginas o el contenido que ve, las búsquedas de Productos o Servicios, las redes sociales y otras acciones realizadas en el Mercado en Línea; (iii) Datos de registro e información del dispositivo (incluyendo si ha hecho clic en enlaces a aplicaciones de terceros), dirección IP, fechas y horas de acceso, información de hardware y software, identificadores únicos, datos de errores, datos de cookies y las páginas que ha visto o con las que ha interactuado antes o después de utilizar el Mercado en Línea; (iv) Cookies y tecnologías similares, tal y como se describen en nuestros Términos; y (v) Información sobre el pago, como el instrumento de pago utilizado, la fecha y la hora, el importe del pago, la fecha de caducidad del instrumento de pago y el código postal de facturación, su dirección y otros detalles relacionados con el pago , incluida la información sobre su interacción con los contenidos y servicios disponibles a través de Redcloud.
    3. En la medida en que lo permita la legislación aplicable, podemos recibir información adicional sobre usted, como referencias, datos demográficos o información para ayudar a detectar el fraude y los problemas de seguridad de terceros proveedores de servicios o socios y combinarla con la información que tenemos sobre usted.
  3. Uso de Datos Personales
    1.     2. Utilizamos los Datos Personales para: (i) crear y mantener un entorno de confianza y seguridad; (ii) detectar y prevenir el fraude, los mensajes no deseados, el abuso, los incidentes de seguridad y otras actividades perjudiciales; (iii) llevar a cabo investigaciones de seguridad y evaluaciones de riesgo; (iv) verificar o autenticar la información que usted proporciona, realizar comprobaciones con las bases de datos y otras fuentes de información; (v) ayudar a resolver conflictos; y (vi) cumplir con la ley, responder a las solicitudes legales, prevenir daños y proteger nuestros derechos.
    3. Utilizamos los Datos Personales para: (i) proporcionar, personalizar, medir y mejorar nuestra publicidad y marketing; (ii) personalizar, medir y mejorar nuestra publicidad; (iii) administrar programas, recompensas, encuestas u otras actividades o eventos promocionales patrocinados u operados por el Mercado en Línea o sus socios terceros; y (iv) analizar las características y preferencias para enviarle mensajes promocionales, marketing, publicidad y otra información que creemos que puede ser de su interés.
    4. Utilizamos los Datos Personales para: (i) permitir o autorizar a terceros el uso de los Servicios de Pago; (ii) detectar y prevenir el blanqueo de dinero, el fraude, el abuso y los incidentes de seguridad; (iii) realizar investigaciones de seguridad y evaluaciones de riesgo; (iv) cumplir con las obligaciones legales (como las disposiciones contra el blanqueo de dinero), y (v) proporcionar y mejorar los Servicios de Pago.
  4. Cumplimiento de la ley
    1. Podemos revelar su información a los tribunales, a las fuerzas de seguridad, a las autoridades gubernamentales o públicas, a las autoridades fiscales o a terceros autorizados en la medida en que nos lo exija o permita la ley o cuando la revelación sea razonablemente necesaria para (i) cumplir con nuestras obligaciones legales; (ii) cumplir con una solicitud legal válida o responder a las reclamaciones presentadas contra RedCloud; (iii) responder a una solicitud legal válida en relación con una investigación penal para hacer frente a una presunta actividad ilegal, o responder a cualquier otra actividad que pueda exponernos a nosotros, a usted o a cualquiera de nuestros otros Usuarios a la responsabilidad legal o reglamentaria.
    2.   5. Proveedores de servicios
    1. Compartimos Datos Personales con proveedores de servicios afiliados y no afiliados para ayudarnos a administrar nuestro negocio, incluidos los proveedores de servicios que nos ayudan a (i) verificar su identidad o autenticar sus documentos de identificación, (ii) cotejar información con bases de datos públicas, (iii) realizar comprobaciones de antecedentes o policiales, prevención de fraudes y evaluación de riesgos, (iv) desarrollar, mantener y depurar productos, (v) permitir la prestación de los Servicios, (vi) prestar servicios de atención al cliente, publicidad o pago, o (vii) procesar, gestionar o evaluar reclamaciones de seguros o similares.   6. Derecho de acceso, rectificación o supresión
    1. El Usuario podrá ejercer sus derechos de acceso, rectificación o supresión, así como solicitar la exclusión de acuerdo con lo establecido en la normativa aplicable en la materia, enviando un correo electrónico a la dirección de correo electrónico del centro de ayuda: soporte@red101.com
    2. En caso de que los Datos Personales sean tratados por terceros, su solicitud de rectificación, supresión o restricción se remitirá también a dichos terceros, salvo que ello resulte imposible o suponga un esfuerzo desproporcionado.
    3. En determinadas jurisdicciones, usted puede solicitar la supresión de sus Datos Personales. Tenga en cuenta que si solicita la eliminación de sus datos personales (i) podremos conservar sus Datos personales en la medida en que sea necesario para nuestros intereses comerciales legítimos, como la prevención del blanqueo de capitales, la detección y prevención del fraude y la mejora de la seguridad, y (ii) podremos conservar y utilizar sus Datos personales en la medida en que sea necesario para cumplir con nuestras obligaciones legales.
  7. Seguridad
    1. La información personal que los Usuarios introducen en el Mercado en Línea es completamente confidencial y haremos todo lo posible para proteger su privacidad. Cuando se introducen los datos y números correspondientes a las tarjetas de crédito, éstos son encriptados según los estándares de seguridad, para mayor seguridad de los Usuarios.
    2. Hemos adoptado los niveles de seguridad de protección de los datos personales legalmente requeridos, y hemos instalado todos los medios y medidas técnicas a nuestro alcance para evitar la pérdida, mal uso, alteración, acceso no autorizado y robo de los datos personales.
    3. Es importante que los Usuarios se protejan contra el acceso no autorizado a sus Cuentas, contraseñas y a sus ordenadores, dispositivos y aplicaciones. Recomendamos utilizar una contraseña única para su Cuenta que no se utilice en otras cuentas en línea. Asegúrese de cerrar la sesión cuando termine de utilizar un ordenador compartido.
  8. Períodos de conservación
    1. Sus Datos Personales sólo se conservarán mientras permanezca registrado en el Mercado en Línea y, en su caso, durante el tiempo que exijan los requisitos legales de conservación. Si cierra su Cuenta, eliminaremos todos los Datos Personales que tengamos sobre usted.
  9. Modificaciones
    1. Nos reservamos el derecho a modificar esta Política de Privacidad en cualquier momento, de acuerdo con la legislación aplicable. En ese caso, publicaremos la Política de Privacidad revisada y también le notificaremos los cambios utilizando el Mercado en Línea al menos treinta (30) días antes de la fecha de entrada en vigor. Brasil – Política de Privacidade
  1. Geral
    1. Esta Política de Privacidade descreve como a RedCloud e suas empresas afiliadas (“nós”, “nosso” ou “RedCloud”), bem como nossos prestadores de serviço não afiliados, tratam os dados pessoais que coletamos por meio do Marketplace. Devido ao caráter B2B (“de empresa para empresa”) do Marketplace (ver Termos e Condições do Uso do Marketplace, Cláusula 2) o processamento de dados pessoais é uma exceção. Por isso, esperamos processar poucos dados pessoais. Todos os termos não definidos no presente instrumento terão o significado que lhes é atribuído nos Termos e Condições de Uso do Marketplace (“Terms and Condições”), que são aceitos pelos Usuários do Marketplace (“Usuários”) com o uso do Marketplace. Os Termos e Condições podem ser atualizados de tempos em tempos à discricionariedade exclusiva da RedCloud.
    2. Para usar o Marketplace de maneira eficiente e segura, os Usuários devem, às vezes, fornecer certas informações/dados pessoais (“Dados Pessoais”), como por exemplo nome e sobrenome, endereço de e-mail, número de telefone, informações de cobrança e qualquer outra informação requerida para prestar os Serviços de Marketplace. Portanto, é necessário que a informação fornecida seja atualizada, verdadeira e precisa. A base para processarmos dados pessoais é a execução dos Termos e Condições de Uso do Marketplace pelos Usuários, o qual constitui um Contrato válido e vinculante. Podemos compartilhar Dados Pessoais com empresas afiliadas.
    3. A RedCloud Technologies Ltd, empresa registrada no Reino Unido sob o nº 08872820, com sede em 50 Liverpool Street, London, Uk, EC2M 7PY, é a empresa responsável pelo tratamento de eventuais Dados Pessoais coletados dos Usuários quando da utilização do Marketplace. O Encarregado pelo tratamento dos referidos Dados Pessoais pode ser contatado através do e-mail compliance@redcloudtechnology.com.
  2. Fornecimento de Dados Pessoais
    1. Os Usuários podem escolher voluntariamente, mas não são obrigados a, nos fornecer, apenas por razões comerciais, Dados Pessoais adicionais, como gênero, idioma(s) preferido(s), cidade ou outras informações, por exemplo quando os Usuários preenchem um formulário, respondem a pesquisas, participam de promoções, se comunicam com nossa equipe de suporte ou compartilham sua experiência conosco.
    2. Além disso, quando Usuários utilizam o Marketplace e os Serviços de Pagamento, coletamos informações pessoais automaticamente. Essas informações podem incluir: (i) Informação de geolocalização, como localização precisa ou aproximada determinada a partir do endereço de IP de dispositivo móvel ou de GPS.     3. Desde que permitido pela legislação aplicável, podemos receber de provedores de serviços terceirizados ou parceiros informações adicionais sobre os Usuários, como referências, dados demográficos ou informações que ajudem a detectar fraudes e problemas de segurança, e combiná-las com informações que temos sobre os Usuários.

    3. Nós usamos Dados Pessoais para: (i) fornecer, personalizar, medir e melhorar nossa publicidade e marketing; (ii) personalizar, medir e melhorar nossa publicidade; (iii) administrar programas, recompensas, pesquisas, ou outras atividades promocionais ou eventos patrocinados ou operados pelo Marketplace ou seus parceiros terceirizados; e (iv) analisar características e preferências para enviar mensagens promocionais, marketing, publicidade e outras informações que acreditamos que possa ser de interesse.
    4. Nós usamos Dados Pessoais para: (i) permitir ou autorizar terceiros a utilizar os Serviços de Pagamento; (ii) detectar e prevenir lavagem de dinheiro, fraude, abuso e incidentes de segurança; (iii) realizar investigações de segurança e análises de risco; (iv) cumprir obrigações legais (como disposições antilavagem de dinheiro); e (v) fornecer e melhorar os Serviços de Pagamento.
    5. Qualquer uso de dados pessoais está relacionado à operação, funcionalidade e melhoria do Marketplace e/ou dos Serviços, e é necessário para e baseado no legítimo interesse da RedCloud ou na preparação ou cumprimento de um acordo com os Usuários.
  4. Cumprimento de lei
    1. Podemos divulgar informações a tribunais, autoridades policiais, autoridades governamentais ou públicas, autoridades fiscais ou terceiros autorizados, desde que sejamos exigidos ou autorizados por lei, ou quando a divulgação for razoavelmente necessária para: (i) cumprir com nossas obrigações legais; (ii) cumprir com uma exigência legal válida ou responder a demandas apresentadas contra a RedCloud; (iii) responder a uma exigência legal válida em relação a uma investigação criminal para tratar de atividades ilegais suspeitas, ou responder a qualquer outra atividade que possa expor a RedCloud ou qualquer de nossos outros Usuários à responsabilidade legal ou regulatória. Jamais divulgaremos informações sem razões legítimas.
    2.   5. Prestadores de Serviços
    1. Quando dados e números correspondentes a cartões de créditos são inseridos, estes são criptografados de acordo com padrões de segurança para maior segurança dos Usuários.
    2. É importante que os Usuários se protejam contra acessos não autorizados a suas Contas, senhas e a seus computadores, dispositivos e aplicativos. Recomendamos utilizar uma senha exclusiva para cada Conta que não seja usada para outras Contas online. Certifique-se de fazer log off quando terminar de usar um computador compartilhado. Em caso de violação, o Usuário deve notificar à RedCloud imediatamente.
  9. Períodos de Conservação
    1. Dados Pessoais serão conservados apenas enquanto o Usuário permanecer cadastrado no Marketplace e, caso aplicável, pelo tempo exigido por disposições legais de conservação. In support of our marketplace platform, we collect and use information about the merchants using our platform, partners that may be offering goods or services to our merchants, users of the third-party apps made available through our Website, including Stripe and visitors to our Website.

  • Information You Provide to RedCloud

    We receive and store any Personal Information you post to the Website or provide to us when you set up a user account, or sign up for our newsletters or promotions. Onward transfer
